What's at Stake

The Department of Justice (DOJ) sued the State of Delaware, seeking its unredacted statewide voter file, including sensitive personal data such as driver’s license numbers and partial social security numbers. DOJ’s efforts appear to be part of an effort to build a national voter database without congressional authorization and to improperly question the validity of state voter rolls.

Summary

The ACLU and ACLU of Delaware have filed a motion to intervene as Defendants in a suit brought by the Department of Justice against the Delaware State Election Commissioner, who refused to turn over voter file information except as required by law. The motion to intervene was filed on behalf of the Latin American Community Center, La Esperanza, Delaware Coalition Against Domestic Violence, and an eligible, registered Delaware voter.

DOJ’s lawsuit appears to be connected to governmental efforts to create a national voter database without congressional authorization, and to question the validity of certain states’ election administration process and voter rolls, and the status of certain voters.

If intervention is granted, the organizations and individual voter will seek to prevent the federal government from forcing Delaware to turn over the entirety of its voter registration database and to protect sensitive data within the voter rolls.
